Wife of former mayor Ockomon sues Teresa Spencer

Ann Ockomon cites ‘emotional distress’

ANDERSON, Ind. — The Ockomon-Spencer saga continues with two sides set to square off in court on Oct. 8.

This time it’s Ann Ockomon, wife of former mayor Kris Ockomon, who has filed a complaint against Teresa Spencer in Madison County Circuit Court 3.

Ockomon is seeking monetary damages for comments and allegations Spencer made that represented her in a false light and intentionally caused her emotional distress, according to the complaint. She filed her suit in July.

Spencer responded to Ann Ockomon’s suit on Aug. 16 by filing for a motion to dismiss. A hearing on the motion is scheduled for Oct. 8. The case has been assigned to Senior Judge Carl VanDorn.

According to the motion to dismiss, Spencer is questioning whether she can be held liable for defamation for statements she made during federal pleadings.

Spencer, who served in the Kris Ockomon administration as an executive assistant, filed lawsuits in 2010 and 2011 alleging the former mayor sexually harassed and discriminated against her. Kris Ockomon filed a countersuit in 2011.

Among Spencer’s allegations was a complaint that Kris emailed her during a business trip in Washington D.C. that he wished Spencer was with him because he had a “handicap” bathroom and an exceptionally large bed for the two of them. Spencer alleged that Ockomon had the city’s IT department deleted the message from her email.

According to Ann Ockomon’s complaint, such allegations have caused her “severe emotional distress”, and has sought professional treatment.

On May 16, 2012, both Kris Ockomon and Spencer, as well as the city, agreed to a $128,000 settlement to end the litigation.

In an interview last winter with The Herald Bulletin, Kris Ockomon said he attributed his defeat to Kevin Smith last November, to Spencer’s lawsuit.

Ockomon’s attorney Chris Gilley did not return voice mails or an email Thursday night.
