Sides hope to have deal before murder trial

ANDERSON, Ind. —  A man facing a charge of murder from a domestic incident in December has a trial date set.

Scott Atherton, 37, is accused of attacking his wife and her father during a domestic dispute on Dec. 9 in his home in the 600 block of Ruddle Avenue.

The father, Douglas Gorbett, went into cardiac arrest, was briefly revived, but later died at St. Vincent Anderson Regional Hospital. Investigators believe his death was a direct result of the injuries allegedly received from Atherton.

Madison County Prosecutor Rodney Cummings said the court date is set, but he’s hoping for a resolution to the case before going to trial.

According to a probable cause affidavit of the incident, police responding to a 911 call from Atherton’s wife found her and her father with visible punch and kick wounds. Both were transported to the hospital to be treated for their injuries.

Atherton’s wife told detectives that Atherton attacked the two in front of their children, and intentionally disconnected the house phone line during the incident to keep the family from calling 911.

Atherton also faces aggravated battery, domestic battery and interference with reporting of a crime charges in addition to the murder charge.

Atherton remains in Madison County Jail on a $23,000 bond.
