Police: Man fired gun into air during argument

ANDERSON, Ind. — Officers needed to call a man out of his house with a PA system after he allegedly shot a handgun in the air during an argument with his wife Friday night.

Dustin M. Bates, 30, of Anderson, faces charges of criminal recklessness with a deadly weapon and possession of a handgun without a permit after the incident, which happened at about 11 p.m. at his home in the 2200 block of East Fifth Street. As of Saturday, he was in Madison County Jail on $5,000 bond.

According to a probable cause affidavit of the incident, dispatchers received a 911 call from a neighbor who heard arguing and a gunshot. When officers arrived at Bates’ home, they needed to call him out using a loud speaker system. Bates, who was allegedly highly intoxicated and had a blood-alcohol content of .15 percent, stumbled out of the house and dropped a 9 mm magazine when officers were handcuffing him.

Bates’ wife told police the two were fighting and she tried to leave the home during the argument. As she left, she heard a loud sound she thought was a CO2 cartridge. She said she was nervous so she came back inside until police arrived. Officers believe Bates had shot a weapon into the air.

After searching the home, officers found a high-powered 9 mm rifle and a .380-calibur handgun on a recliner where Bates was sitting.

According to public records, Bates was arrested for battery in May 2012 and pleaded guilty. He received a year of jail time and was required to enter an anger control program. He was apparently still on probation during Friday’s incident.
