ANDERSON — The Madison County Prosecutor’s Office filed charges Friday against an Anderson man accused of shooting one nightclub patron in the head and wounding another in the abdomen during the early-morning hours of Sunday, May 11.

Marquis A. Foard, 22, is charged with:

• Attempted murder, a Class A felony punishable by 20 to 50 years in prison

• Aggravated battery, a Class B felony that carries a term of six to 20 years

• Criminal recklessness resulting in serious bodily injury, a Class C felony that has sentencing range of two to eight years

• Unlawful possession of a firearm by a serious violent felon, a Class B felony

• Carrying a handgun without a license, a Class A misdemeanor punishable by up to a year behind bars

• A enhanced count of carrying a handgun without a license, a Class C felony.

Foard was arraigned on the charges Friday. Madison County Magistrate Stephen Clase entered an automatic not guilty plea on Foard’s behalf. He is being held in the Madison County Jail without bond for allegedly violating the terms of his probation for a prior conviction for armed robbery.

According to a probable cause affidavit filed with the charges in the most recent case:

Police were called to Club 765, 1637 Nichol Ave., at about 3 a.m. Sunday after receiving calls about a possible shooting. When they arrived, they found Stevaughn Fuller, 20, Anderson, suffering a gunshot wound to the head, and 24-year-old Andrea Mitchell wounded in the stomach.

During the investigation, detectives learned there had been some type of altercation between Foard and Fuller’s sister, Stasia Fuller, while they were on the dance floor. Stevaughn Fuller went to help his sister, but Foard pulled a .40-caliber handgun from his waistband and began firing.

Wounded, Stevaughn Fuller began crawling away, but Foard walked up to him, pointed the gun at him and began kicking him in the head. Foard then ran out of the crowded club, but the shootings were recorded by the bar’s video surveillance system.

Witnesses were able to identify Foard. He admitted to being on the dance floor, but denied shooting either Fuller or Mitchell or seeing anyone open fire. He was arrested at about 2 p.m. Monday at the police department.

Methodist Hospital officials said Fuller was released earlier this week. Mitchell remains in the Indianapolis’ hospital’s care, but information about her condition is not being released.
