Man pleads guilty to three drug-related incidents, receives sentence

ANDERSON, Ind. — A man who racked up three separate felony drug charges in four years was sent to prison on Monday.

Solomon J. Fitzgerald, 29, of Anderson, received an 18-year sentence from Judge David Happe of Madison Circuit Court 4 after pleading guilty to various charges from three separate drug-related incidents dating back to 2008, according to court records.

The first charge stemmed from an incident in 2008, when Fitzgerald was stopped by police for operating a moped with no headlights or tail lights. According to the probable cause affidavit of that incident, police found several bags of marijuana totaling 64 grams on Fitzgerald.

In March 2012, Fitzgerald was arrested again and charged with being a violent felon in possession of a handgun, dealing marijuana and resisting arrest. Police said he drove dangerously fast during an attempt to pull over a vehicle he was driving. When they arrested him later, he had a strong smell of marijuana and had several bags in his pockets.

Fitzgerald was arrested again in October and charged with resisting law enforcement, operating a vehicle while intoxicated and possession of marijuana.

In January, Fitzgerald and attorney Jimmy McDole requested that two doctors be appointed to determine whether Fitzgerald was competent to stand trial. After the doctors determined he was competent, Fitzgerald pleaded guilty.

The three convictions led to a composite sentence of 18 years, and 11 1/2 will be spent in prison, said Madison County Prosecutor Rodney Cummings.
