City files lawsuit against local union

ANDERSON, Ind. — The city of Anderson has placed a temporary restraining order on a local union.

The most recent agreement between the city and the United Automobile, Aerospace and Agricultural Implement Workers of America, or UAW Local 1963, apparently expired on Dec. 31, 2012, and is therefore no longer valid, the complaint from the city claims. In the complaint, the city wants a declaration that the collective bargaining agreement between it and UAW is no longer valid and for the union to stop trying to use the agreement for relief.

City attorney Ashley Hopper said she had nothing to add about the lawsuit.

“We feel it’s pretty self-explanatory, and I’ll leave it at that,” Hopper said.

United Auto Workers was founded during the unionization boom of the 1930s. Headquartered in Detroit, UAW represents groups of governmental employees regarding wages, benefits and working conditions. UAW has two branches in Madison County besides 1963.

Attempts to contact Local 1963’s president Julia Lewis were unsuccessful.

According to the complaint, the agreement between the two parties, which includes standards and stipulations on bargaining, was set to expire in 2011. An automatic extension gave the agreement a one-year renewal that expired on the new year. Since the agreement is no longer in effect, the city wants UAW to stop using it in negotiations.

The complaint asks for a declaratory judgment from the court to settle the future legal relations between the city and the union.

Public court records indicate a hearing for the two parties was scheduled for Monday at 11 a.m. in Madison Circuit Court 6 but an agreement pushed the hearing back to May 6.
