ANDERSON, Ind. —
A teen accused of raping an 11-year-old girl is in police custody and will be charged as an adult, Madison County Prosecutor Rodney Cummings said.
Victor M. Perez, 17, was arrested at 2 p.m. Friday at the Anderson police department, according to police records. He faces a charge of rape, and Cummings has decided to waive him to adult court.
An initial hearing for Perez was set for Friday but was delayed because a Spanish-speaking interpreter was not available. The hearing is now set for 1 p.m. Monday, Cummings said.
Madison County Circuit Court 3 Judge Thomas Newman, Jr., appointed Anderson attorney Steve Smith to act as a guardian for Perez because he has no family available, Cummings said.
The court for Perez’ initial hearing will be determined at random before the hearing.
