ANDERSON — Three Anderson men have been arrested on charges of rape through the use of force or the threat of force for an incident that took place on April 9.

The Madison County Sheriff’s Department has charged Jermaine S. Heard, 28, 100 block of West 5th Street; Kendarius Ivory, 27, 2100 block of McKinley Street; and Damon Fuller, 25, 5800 block of Scatterfield Road, with Level 3 felony rape.

All three were detained on a $20,000 bond.

Fuller was arrested on April 19, Ivory on June 6 and Heard appeared in video court on Tuesday.

If convicted, they face a possible prison sentence of three to 16 years.

According to the probable cause affidavit, on April 9 the woman went to visit her niece at her boyfriend’s house in the 1100 block of School Street.

She told police that she drank some Four Loko, got sick to her stomach and gave it to Fuller to drink. Heard was reportedly smoking “Katy” (spice), and Fuller also smoked the spice.

The woman said she went to lay down in Heard’s room and that Fuller laid down next to her and started touching her through her clothes.

Court records show that Fuller and Ivory had sex with her. At one point, she allegedly was forced to perform a sex act on both men at the same time.

The woman said Heard then entered the room and forced her to perform a sex act on him.

Fuller told investigators the sex was consensual and said all three had sex with the woman.

Heard refused to be interviewed by deputies.

The woman indicated she told her niece and her boyfriend want had happened and stayed in their room the rest of the night.

Heard has been convicted of criminal deviate conduct by the use of force or threat of force in 2016 and 2013.
