Residents sue over ministry's shelter plan

Utica, Ind. —

Residents in a southern Indiana town are suing a ministry and a local government official over plans to turn a former elementary school into a home for battered women and children.

Members of Old Utica School Preservation Inc. claim in their suit that Jacob's Well's plan violates a deed restriction put in place when the Greater Clark County School Corp. donated the property to Utica Township in 2002.

The Courier-Journal of Louisville, Ky., reports the complaint says the deed states the property "shall be used by Utica Township solely for park and recreation purposes."

The suit also names Township Trustee John Durbin. Jacob's Well is a nonprofit run by Barbara and Kevin Williar, who've lived in the old school building in the Ohio River town since 2011.
